Government Asks Court to Dismiss Kyarenga Concert Case

The Attorney General and the Inspector General of Police who are respondents in a case where events managers Andrew Mukasa aka Bajjo and Abbey Musinguzi aka Abitex accuse government of illegal cancellation of their ‘Kyarenga’ concerts have asked court to dismiss the matter.

Bajjo and Abitex went to court seeking for orders declaring IGP’s directive that stopped their Kyarenga concerts as null and void and thus asked court to order Police to provide security at all their future concerts than blocking them.

In their reply filed in court and received by applicants, the two respondents informed court that Bajjo and Abitex in all their submissions failed to prove any grounds to succeed in an application for Judicial review

“We oppose this application for Judicial review and it’s our submission that the application is devoid, frivolous, an abuse of court process and ought to be dismissed with costs to respondents.”

The Attorney General blamed the duo through their lawyers of Lukwago and Company Advocates for bringing to High Court matters that require constitutional interpretation through a notice of motion.

Being that they accuse the Inspector General of Police of violating their rights under articles 20,23,28,40 and 42 when he stopped their concerts, the AG says they should have taken it before constitutional court in case of any interpretation.

Director in Charge of Operations of Police AIGP Asuman Mugenyi, said in his affidavit that Bajjo and Abitex were given directives and guidelines which they breached and that Police had no option but to cancel the concerts.

The matter was supposed to come up for highlighting of submissions by both sides but on reaching court, the applicants and their lawyers were surprised to hear that it will not proceed and no clear adjournment date was given.

In response to this, Bajjo informed the press that their hope has been lost but that they will declare their next move in the coming week

Lawyer Erias Lukwago expressed worry about the economic implication to his clients who might not be able to conduct their business of organizing events in the forthcoming festive season
