Kabale High Court Halts Sale Municipal Yard

High Court in Kabale has issued an interim order barring Kabale Municipal Council from transferring the title or registration and giving possession of the Kabale municipal council yard on Plots 11-17, Mbarara road to A Kampala based lawyer Cephas Birungyi Kagyenda until the main suit is heard and determined.

The Kabale High Court assistant registrar, Didas Muhumuza issued the order following a petition by one Wilson Mbabazi over the manner in which the land was sold off.

According to the sale agreement, Kabale Municipality sold its yard to Cephas Birungyi Kagyenda who is also the Kabale district land board chairperson on 27th December 2019 at Shs1billion.

The yard has been housing among others a Health Centre II, a store and the district education offices.

The petitioner, Mr Mbabazi through his lawyers of M/S Bemanyisa and Co. Advocates asked court declare the sale null and void on grounds that it contravened the Public Procurement Disposal of Assets (PPDA) Act.

Mbabazi claims among others that the Municipal leadership never consulted the residents on the sale of the yard, but that the mayor sat in a meeting with his executive and the speaker and passed the sale of public land.

Emmanuel Sentaro Byamugisha the mayor Kabale municipality says they have received the court order and will consult their lawyers for the way forward.
