Court Sets Deadline in Kato Lubwama-Habib Buwembo Case

The three Court of Appeal justices have issued guidelines to be followed in the matter in which Hon Kato Lubwama challenges the High Court decision granting permission to Rubaga South voter Habib Buwembo to file an election petition out of time.

The matter was among the 63 which were coming up on Monday for hearing but the justices instead ordered that the matter must proceed by formal submissions.

The matter is before Justice Geoffrey Kiryabwire, Elizabeth Musoke and Irene Mulyagonja.

These ordered Buwembo’s lawyers led by Isaac Ssemakadde to file their submissions by July 29, and Kato Lubwama’s side is to respond by July 31, 2020.

On Monday, when the matter came for hearing before a panel of three justices including Geoffrey Kiryabwire, Elizabeth Musoke and Irene Mulyagonja, the court asked all the parties to file written submissions and wait for the court’s ruling.

“We shall deliver our ruling on notice,” Justice Kiryabwire said.

Buwembo petitioned High court seeking for permission to challenge Kato’s election on grounds that he  lacks the Primary Leaving, Uganda Certificate of Education and Uganda Advanced Certificate of Education documents to enable him be in parliament.

Justice Margaret Oumo Oguli granted Buwembo permission to proceed with filing the petition which forced Kato to appeal against that decision in 2017.
