High court judge Jane Frances Abodo has sentenced Diana Nabbengo Luutu, a former employee of Public Procurement and Disposal of Assets to 25years in jail after convicting her of murdering her husband Musasizi Asiimwe Hanington.
The judge in her ruling noted that the prosecution proved beyond reasonable doubt that Nabbengo on 24th August 2016 at Kazo, Kawempe Division in the Kampala District, with malice aforethought unlawfully killed her husband.
“PW 5 testified in court that on 27th August 2016 the deceased revealed to him that he had been stabbed by his wife which was later corroborated by a post-mortem report which revealed that the death was a result of trauma inflicted by a sharp edged object,” she ruled.
Abodo further pointed out the fact that the injuries targeted sensitive parts of the body and being that the medical officer ruled out the fact that they could have been self-inflicted.
Before sentencing her the judge considered the fact that Nabbengo is a first offender, and a young woman capable of reforming
“I consider a reformative sentence of 30 years to be appropriate. However, I consider further that she is the only parent left of those three children and she had other family responsibility and she is already showing signs of reform by joining women groups in Prison. I further reduce the sentence to 25 years imprisonment.”
The Principal State attorney Nakafeero Fatina in her submissions had asked court to grant the convict a deterrent sentence on grounds that the offence of which she was convicted carries a maximum penalty of death.
However, Counsel Henry Kunya prayed for a lenient custodial sentence because the convict is a first offender and remorseful, and capable of reforming.
