Interdicted RDC Sakwa Appeals Against High Court Ruling

 

The Interdicted RDC of Jinja District Eric Joseph Sakwa has petitioned the Court of Appeal seeking reversal of the Jinja High court ruling that his interdiction was lawful.

In his notice of Appeal dated 2nd June 2020, filed by his lawyers of Nyote and Company advocates, Sakwa says he is dissatisfied with the whole ruling.

“Take note that Sakwa Eric Joseph is dissatisfied with the ruling of Hon Justice Jeane Rwakakoko delivered electronically on 1st June 2020. In this application he appeals to Court of Appeal against the whole ruling.” Reads the notice.

In the ruling delivered yesterday, High Court dismissed Sakwa’s application on grounds he was lawfully interdicted since he is a Public servant appointed by the President and thus has to abide by public service standing orders.

Court also defined interdiction basing to the Public standing orders as a temporary removal of a public officer from exercising his or her duties as he is being investigated over a particular misconduct.

In this matter court said, Sakwa is charged with Manslaughter charges which are pending hearing before Jinja Magistrates court and thus it’s in order to first ask him to step aside until the matter is concluded.

Sakwa had rushed to High challenging his interdiction on grounds that Hajji Yunus Kakande, the secretary in the office of the president didn’t follow required procedures in interdicting him on duty

Secondly he pointed out that it was wrong for him to be interdicted yet he is not a public servant on top of being that that was not among the working terms and conditions he received while assuming office.

He was granted a temporary injunction ordering that he should stay in office until his application is heard and disposed of.

But this was short lived after President Yoweri Museveni the appointing authority ordered him to step aside for two months pending hearing of his case.

Sakwa is charged with Manslaughter of Jinja business man Charles Isanga alongside two others.
