Minister Ogwang Faces Court Battle Over Academic Papers
Emmanuel Byamukama Tayebwa, a concerned Ugandan through his lawyers of Mushabe, Munungu and Company advocates has vowed to drag the newly appointed ICT Minister and Usuk constituency member of Parliament Hon Peter Ogwang to court for holding the offices with no education qualifications.
In the notice of intention to sue dated 6th January 2019, Byamukama asked Ogwang to resign from the Parliamentary seat before a legal action is taken against him.
“The purpose of this notice is to categorically demand that you either resign from Parliament and decline ministerial appointment accordingly.”
In the same letter Ogwang is accused of “misleading the president” which resulted in his recent appointment to cabinet.
“That on 3rd January 2019 you were vetted in Parliament based on falsified academic certificates contrary to the laws of Uganda,” the letter goes on.
As such, Byamukama wants court to declare Usuk Parliamentary seat vacant as well as costs for the suit.
In response to the intention to sue, Ogwang’s lawyers of K and K advocates, confirmed receipt of the letter and asked Byamukama to proceed with the intended legal action against their client
In his official statement, Ogwang also revealed that he is aware of the “spreading rumors” about his qualifications but since he was legally nominated in both 2011 and 2016 he cannot be intimidated by anybody
“It is their right to challenge the matter in the courts of law rather than continue soiling my name on social media.
His utterance is simply deceptive, malicious, and fraudulent and contains elements of defamation – a ground on which I am considering engaging my lawyers for the next course of action.”
